Regulation 2025/14 was signed on 19th December 2024 with the date of effect being 28th January 2025. The regulation concerns the approval and market surveillance of non-road mobile machinery circulating on public roads with amendments to Regulation (EU) 2019/1020.

The regulation excludes non-road mobile machinery with a maximum design speed exceeding 40 km/h or lower than 6 km/h, machinery equipped with more than three seating positions, including the driver, machinery primarily intended for the transport of one or more persons, animals or goods, and non-road mobile machinery that was placed on the market, registered or entered into service before 29 January 2028. 

The regulation also clarifies that member states may limit or prohibit the circulation on public roads or the registration of non-road mobile machinery that due to its fully automated, or remotely operated, driving system for on-road use, the machinery is subject to restrictions under national traffic law.

The regulation aims to minimise the risk of injury to persons and of damage to road infrastructure while non-road mobile machinery is circulating on public roads, by setting out technical requirements. The technical requirements should include subjects relating to road safety such as vehicle structure integrity, maximum design speed, speed governor, speed limitation devices and speedometer, braking devices, steering, field of vision, and masses and dimensions. The technical requirements should take into account synergies between the machinery function and the on-road use function of the non-road mobile machinery. 

For autonomous off-highway vehicles that meet these requirements, the Commission can lay down rules for additional requirements due to technical and scientific progress, such as driver assistance systems and automated and remotely operated driving systems in order to keep those technical requirements sufficiently future-proof.

Manufacturers are obliged to design, construct and assemble non-road mobile machinery to minimise the risk of injury to the occupants and to other persons and the risk of damage to road infrastructure, in the machinery’s surrounding area, while that non-road mobile machinery is circulating on a public road. 

The manufacturer, or its EU based representative if based outside of the union, shall submit to the approval authority an application for EU type-approval with an information folder provided. An approval authority which grants an EU type-approval shall take the necessary measures to verify that adequate production arrangements have been made to ensure that the non-road mobile machinery in production conforms to the approved type and documented control plans, to be agreed with the holder of EU type-approval for each approval
